Terms & Conditions

Ferouchi provides software for sales operations, outreach, inbox and reply management, customer records, pipeline workflows, reporting, and AI-assisted work. Features may vary by plan, configuration, region, and connected service. We may improve or modify the Services over time.
2. Accounts and organizations
You must provide accurate information, keep credentials confidential, and promptly notify us of suspected unauthorized access. Organization administrators may manage users, roles, data, subscriptions, and connected accounts. You are responsible for actions taken through your account and for ensuring that authorized users follow these terms.
3. Customer data
You retain ownership of data and content submitted to the Services (“Customer Data”). You grant Ferouchi the limited rights necessary to host, process, transmit, display, and otherwise use Customer Data to provide, secure, support, and improve the Services. You represent that you have all rights and permissions required to provide Customer Data and instruct us to process it.
4. Outreach and communications compliance
You are solely responsible for your campaigns, audiences, messages, and use of connected channels. You must comply with applicable privacy, marketing, anti-spam, consumer protection, telemarketing, and platform rules, including consent, identification, opt-out, suppression, and recordkeeping requirements. You may not use the Services to send unlawful, deceptive, abusive, or unsolicited communications.
5. Acceptable use
You may not: access the Services unlawfully; interfere with their operation or security; probe or bypass access controls; upload malicious code; scrape or resell the Services except as expressly permitted; infringe rights; impersonate others; send prohibited content; or use the Services to develop or benchmark a competing product without written permission. We may suspend activity that creates security, legal, reputational, or operational risk.
6. AI-assisted features
AI output is generated from patterns and may be inaccurate, incomplete, or inappropriate. You must review output before relying on or sending it and remain responsible for the resulting communication and decision. Do not submit sensitive information unless necessary and permitted. AI features are not professional legal, financial, medical, or compliance advice.
7. Connected services
The Services may connect to third-party email, messaging, calendar, payment, AI, or other services. Your use of those services is governed by their terms. We are not responsible for third-party services, changes, outages, or data handling, and features may stop working if access is changed or withdrawn.
8. Fees, billing, and taxes
Paid plans are billed according to the applicable order or checkout terms. Unless stated otherwise, fees are non-refundable and exclude taxes. You authorize us and our payment providers to charge amounts due. We may suspend paid features for overdue amounts after reasonable notice. Plan changes, renewal, and cancellation terms shown at purchase form part of these terms.
9. Confidentiality
Each party may receive non-public information from the other. The receiving party will use reasonable care to protect it, use it only for the relationship, and disclose it only to people who need it and are bound by confidentiality obligations. These duties do not apply to information that is public through no breach, already lawfully known, independently developed, or lawfully received from another source.
10. Intellectual property
Ferouchi and its licensors own the Services, software, designs, documentation, and related intellectual property. These terms give you a limited, non-exclusive, non-transferable right to use the Services during the applicable subscription. Feedback may be used without restriction or obligation.
11. Suspension and termination
You may stop using the Services at any time, subject to applicable billing commitments. We may suspend or terminate access for material breach, nonpayment, security risk, unlawful use, or harm to the Services or others. Where practical, we will provide notice and an opportunity to cure. On termination, access ends and data is handled according to our retention practices and any applicable agreement.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee deliverability, reply rates, meetings, revenue, or other business results.
13. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, or data. Ferouchi’s total liability arising from the Services will not exceed the fees paid or payable for the Services during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.
14. Indemnification
You will defend and indemnify Ferouchi against third-party claims arising from Customer Data, your campaigns or communications, your violation of law or third-party rights, or your material breach of these terms. We will provide reasonable notice and cooperation and allow you to control the defense, subject to our right to participate.
15. General terms
You may not assign these terms without our consent, except in connection with a merger or sale of substantially all relevant assets. We may assign them as part of a corporate reorganization or transaction. Neither party is liable for events beyond reasonable control. If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. These terms, together with applicable orders and referenced policies, are the entire agreement regarding the Services.
16. Changes and contact
We may update these terms and will provide notice when required. Continued use after the effective date means you accept the revised terms. Questions may be sent to legal@ferouchi.com.
